كتاب "أدب المفتي والمستفتي" من الكتب المشهورة التي ذكرها المصنفون ونسبوها لابن الصلاح، واهتموا بها واقتبسوا منها الكثير، ولا عجب في ذلك فابن الصلاح كما وصفه الذهبي: وهو أحسن من"أشغل، وافتى، وجمع وألف"، تخرج به الأصحاب وكان من كبار الأئمة.
وفي هذا الكتاب يتحدث المصنف عن شروط المفتي وأوصافه، وأحكامه، وعن صفة المستفتي وأحكامه، وعن كيفية الفتوى والاستفتاء، وآدابها جامعاً فيه شمل نفائس التقطها من خبايا الروايا، وخفايا الزوايا، ومهمات تقر بها أعين الفقهاء، ويرفع من قدرها من كثرت مطالعته من الفهماء، ويبادر إلى تحصيلها كل من ارتفع عن حضيض الضعفاء مقدماً: بيان شرف مرتبة الفتوى وخطرها، والتنبه على آفاتها وعظيم غدرها... ولما كان الهدف من التحقيق هو نشر النص المحقق وإثبات صحته.
لذا فإن عمل المحقق في هذا الكتاب قد تركز على النقاط الآتية: أولاً: نشر نص الكتاب مضبوطاً بالشكل. ثانياً: المقارنة بين النسخ وإثبات ما هو أولى بالصواب، ثالثاً: عمل ترجمة مختصرة للأعلام الذين ذكرهم المؤلف في كتابه، رابعاً: عزو الآيات القرآنية إلى السور.خامساً: تخريج الأحاديث النبوية التي وردت في الكتاب تخريجاً علمياً: سادساً: تخريج النصوص التي ينقلها ابن الصلاح في أقوال الأئمة الذين سبقوه. سابعاً: التحقيق في بعض الاختلافات حول بعض المسائل التي ترد في النصوص، من اعتراضات لابن الصلاح، أو اعتراض عليه، أو غير ذلك مما له علامة بتحقيق النص أو إيضاحه للقارئ.
