تعد شبكة الإنترنت أكثر التقنيات أهمية في عصر يسمى بعصر المعلومات، وهي وليدة التزاوج بين نظم الحوسبة ونظم الإتصالات. فقد أحدثت هذه الشبكة قفزة نوعية في نشر المعلومات بين الأفراد في كافة أرجاء العالم، حتى اندمج العالم بأسره، فبدا وكأنه أسرة واحدة، بعد أن تحرر من قيود المكان والزمان.
وأسوة بهذه الثورات، وبقدر ما كان لشبكة الإنترنت من إيجابيات في مجال الاتصالات وتبادل المعلومات، راحت تظهر سلبيات هذا العالم الإفتراضي في مجال الإجرام. حتى احترف البعض ارتكاب شتى أنواع الجرائم التقليدية والمستحدثة عبر هذه الشبكة. ونتيجة لذلك دفعت أكثر المجتمعات ضريبة باهظة لقاء هذه التكنولوجيات المتطورة، التي قدمت للمجرمين اختصارا لمفهومي الزمان والمكان.
في هذا الإطار يعد موضوع الإحتيال عبر الإنترنت من الموضوعات الجديدة والمهمة جدا في إطار القسم الخاص من قانون العقوبات. فلا يخفى على أحد ما لهذه الجريمة من آثار سلبية على المستوى الإقتصادي للفرد والمجتمع بشكل عام.
وموضوع الإحتيال عبر الإنترنت من الموضوعات التي لا تزال بكراً، والتي لم تنل حظها من البحث والتمحيص على مستوى الفقه الجزائي، إذ إن معظم جوانب هذه الجريمة لا تزال غامضة، تحتاج إلى من يسبر أغوارها، خاصة في ظل غياب النص التشريعي الذي يكافح هذا النوع من الإجرام المستحدث في بعض الدول مثل سورية، فأغلب الدراسات المنشورة في مجال جرائم الإنترنت، اقتصرت على البحث في عموم هذه الجرائم دون الغوص في أعماقها، فلم تتناول مختلف الجوانب المتعلقة بكل جريمة على حدة.
و من هنا تأتي أهمية موضوع هذا البحث، الذي يمكن الإستفادة منه عل أرض الواقع، حيث يتناول التصورات والرؤى المتعلقة بالجوانب الموضوعية والجوانب الإجرائية للإحتيال عبر الإنترنت، في محاولة لتقديم الحلول القانونية الممكنة لمكافحة هذه الجريمة في ظل النصوص التشريعية الحالية في سورية.
