إستلفت موضوع الوقف في عصرنا الحاضر انتباه العلماء ورجال الفكر الإسلامي والقانون واهتماماتهم الخاصة لأن الوقف يعدّ كمؤسسة كبرى وقرية دينية عظيمة لها أبعاد إنسانية وحضارية واجتماعية واقتصادية. ولا شك أن قضية الوقت في بلاد الهند تعتبر من أبرز المشكلات من الناحية الإدارية والتنظيمية والإنتاجية وحفظ الممتلكات الوقفية والقانونية. ومن الجدير بالذكر أن الأوقاف في الهند تعاني أنواعاً من المشاكل والضغوط السياسية والتشريعية والحكومية بعد الاستعمار الإنجليزي وبعد تحرير البلاد.
نظراً إلى أبعاد قضية الوقف المتنوعة قام مجمع الفقه الإسلام في الهند باختيار الموضوع لإثارة التساؤلات حوله والنقاش عنه عن طريق إعداد قائمة الأسئلة المفصلة بخصوص الموضوع وإرسالها إلى رجال القانون والمسؤولين الحكوميين والعلماء والخبراء للاستكتاب والمساهمة العلمية في تقديم البحوث والآراء الفقهية. اتخذ المجمع موضوع الوقف أول موضوع ندوته الفقهية العاشرة التي كانت خير اجتماع فقهي نوقشت فيه جوانب عديد من المشاكل الوقفية بداخل الهند على وجه الخصوص والمسائل الأخرى الناجمة المتصلة بشؤون الوقف، بناءً على أهمية الموضوع والبحوث العلمية قرر المجمّع نشر بحوث مختارة منتخبة من البحوث الكثيرة التي قدّمت في الندوة الفقهية العاشرة. وهذا الكتاب الذي بين أيدينا يحتوي مضمون هذه البحوث وهو من إعداد أمين عام مجمع الفقه الإسلامي في الهند سماحة الشيخ القاضي "مجاهد الإسلام القاسمي".
هذه أبحاث مختارة مما قدم في الدورة العاشرة من مجمع الفقه الاسلامي في الهند من بضعة عشر باحث حول : نظام الوقف في الهند، وأحكام الوقف، وكلمة أصولية في الوقف، ومشاكله وحلوله، واستبداله، ومسائل معاصرة، وتنميته، وتاريخه، وبعض قوانين الهند المتعلقة به، وبآخر الكتاب قرارات المجمع المذكور في دورته ذلك.
