Book Description
بيّن الله تعالى للمسلمين، في خطاب موجه إلى الأمة، أن القضاء الذي يتولاه القضاة، أو تتولاه هي عن طريق قضاتها، يجب أن يتحرى العدل بحسب مقاييس الشريعة الإسلامية. وهذا الكتاب ذخرٌ نفيس مما كتبه السيد أبي القاسم الموسوي الخوئي (1317-1413ه) عن القضاء في الإسلام، ووسمه بـ "المعتمد في القضاء والشهادات والحدود"، وقد شرح فيه (305) مسألة من مسائل القضاء هو مما يحتاجه العاملون في القضاء لإقامة حدود الله، والحكم في العدل فيما يُعرض عليهم. ولأهمية هذا المخطوط عمل على تحقيقه وتصنيفه السيد محمد رضا الموسوي الخلخالي (1344-1411ه). قدم له بمقدمة عن تاريخ القضاء في الديانات السماوية الثلاث وأهميته، وترجم للمؤلف ومكانته العلمية وعرض آثاره المطبوعة بما فيها من مخطوطات وتقريرات لبحوث اشتغل عليها في حياته. أما عن النسخة الخطية لهذا الكتاب فعمل على شرحها وتوضيحها، ووضع الأدلة على أهميتها، وخرج الآيات القرآنية وضبط النص، وإتماماً للفائدة وضع متن (مباني المنهاج) في آخر الكتاب.
واستناداً إلى ما تقدم، توزعت مسائل الكتاب إلى ثلاثة أقسام: القسم الأول (كتاب القضاء) ويضم: 1- أحكام اليمين، 2- حكم اليمين مع الشاهد الواحد، 3- فصل في القسمة، 4- فصل في أحكام الدعاوى، 5- فصل في دعوى الأملاك، 6- فصل في الإختلاف في العقود، 7- فصل في دعوى المواريث، القسم الثاني (كتاب الشهادات) ويضم: 1- فصل في شرائط الشهادة، ويضم مئة وثلاثة وثلاثين مسألة في هذا الباب، القسم الثالث (كتاب الحدود) ويضم: الحدود وأسبابها وهي ستة عشر: الأول: الزنا وحدّ الزاني، الثاني: اللواط وكيفية قتل اللائط، الثالث التفخيذ، الرابع: تزويج ذمية على مسلمة بغير إذنها، الخامس: تقبيل المحرم غلاماً بشهوة، السادس: السحق، السابع: القيادة "القوّاد"، الثامن: القذف، التاسع: سبّ النبي صلى الله عليه وسلم، العاشر: دعوى النبوّة، الحادي عشر: السحر، الثاني عشر: شرب المسكر، الثالث عشر: السرقة، الرابع عشر: بيع الحرّ، الخامس عشر: المحاربة "شهر السلاح" السادس عشر: الإرتداد. وأخيراً (التعزيزات) وفيها إجابة على مسائل ذات صلة.
