يظن بعض الناس أن الدين الإسلامي قاصر عن مجاراة العصر، ويظن بعض علماء المسلمين إحاطتهم بعلوم الدين كلها، ومعرفتهم بالقضايا المعاصرة والمستجدة، فيتصدون لإصدار الفتاوى في كل شاردة وواردة، وتختلف الفتاوى باختلاف المفتين وإمكاناتهم وأماكنهم، فيختلف الأتباع والمقلدون، ويتعزز الانقسام في الرأي في القضية الواحدة. وسنها هؤلاء عن سيرة الرسول صلى الله عليه وسلم الذي كان يشاور أصحابه وأهل العلم والمعرفة في كل ما يواجهه من أمور لم ينزل فيها وحي من الله عزّ وجل، ولم ينتبهوا إلى توجيهه الكريم المسلمين عندما سأله علي بن أبي طالب (رضي الله عنه): يا رسول الله، الأمر ينزل بنا لم ينزل فيه قرآن، ولم تمض فيه منك سنة، قال: (اجمعوا له العالمين من المؤمنين، فاجعلوه شورى بينكم، ولا تقضوا فيه برأي واحد).
في هذا الكتاب أبحاث معمقة تتناول الاجتهاد الجماعي المنشود وأحكامه، والصفات الواجب توافرها في المجتهدين، ومجالات هذا الاجتهاد، وآلياته، وأدواته، ويطرح طريقة علمية عملية للوصول إليه، بعد أن غدا الاجتهاد الجماعي حاجة ملحّة للمسلمين، إن أرادوا مواكبة العصر، مع الالتزام بشريعتهم الغراء، فسعى أن يستفيد منه المثقفون والمختصون وعامة المهتمين بشؤون دينهم ودنياهم.
