تعد الصناعة المالية الإسلامية أحد روافد المنظومة الإقتصادية التي تسعى إلى تطوير منتجاتها بمعايير وضوابط وآليات تعكس خصوصية المنهج المتبع في تعاملاتها، إلا أن صناعة المال لا بد وأن تفرز تبايناً في الأفكار والمنهج كلما اتسعت دائرة العلاقات المالية، وتنوعت الأساليب الإستثمارية، مما يشكل مجالاً واسعاً لحصول النزاع والخلاف، وهنا برز دور التحكيم كآلية لتسوية النزاعات الناشئة كبديل عملي عن قضاء الدولة، هدفه البعد عن التعقيدات والتراخي الذي تتعرض له نزاعات الإستثمار داخل أروقة المحكمة.
وينتظم التحكيم في قانون يوضح آلياته بدءاً من العقد التنظيمي الذي يفوض فيه الأطراف للمحكم بنظر النزاع، ومروراً بالإجراءات المتبعة في إدارة العملية التحكيمية، وإنتهاءً بالحكم الفاصل والمنهي للخصومة، والذي سيرتب آثاراً تتعلق بتنفيذ الحكم، وإيصال الحقوق تعد عنوان الوصول للحق وفق أسس العدالة، وقد بينت هذه الدراسة التنظيم الشرعي والقانوني لعملية التحكيم في نزاعات الصناعة المالية، وفق منظومة الشريعة الإسلامية الغراء، ومقارنته بالقانون النموذجي للتحكيم التجاري الدولي (اليونسترال) وهو من القوانين الدولية الذي لاقى قبولاً عند كثير من الدول لتتبناه كأساس في إدارة عمليات التحكيم.
ويظهر مجال التحكيم في الواقع التطبيقي خطوة جدية في ولوج باب التجديد والتطوير ليس على مستوى الخلافات المالية الوطنية فحسب، بل على مستوى النزاعات المالية الدولية، مما سيؤدي إلى أن تكون العلاقة بين المؤسسات المالية على المستوى الدولي أشد ترابطاً بعلاقاتها من ترابط الحكومات نفسها، وهو ما سيهيِّئ لإقتصاد عالمي جديد.
