إن مما لا اختلاف فيه بين المسلمين عامة أن كل ما يصدر عن الإنسان من قول أو فعل أو تصرف، أو أي نوع آخر لا بد أن يكون له في الشريعة الإسلامية حكم داخل في إطار الأحكام الخمسة، من وجوب أو ندب، أو إباحة أو تحريم أو كراهة.
ولهذا الاعتبار احتاج المسلمون عبر العصور إلى من ينير لهم الطريق ويبين لهم الحلال من الحرام من علماء هذه الأمة.
فخلو المجتمع من أهل الفتوى أو عدم قيام المفتين بواجبهم كل ذلك يؤدي إلى تخبط الناس في ظلمات الجهل، فيحترموا ما أحل الله تعالى، ويحلوا ما حرم الله تعالى.
ولخطورة الموقف ولأهمية الفتوى في حياة المسلمين اليومية، قام علماء هذه الأمة بإيضاح أمر الفتوى للعامة والخاصة، فألفوا الكتب في أحكام الفتوى والقضاء، وما يتعلق بهما.
وفي هذا الإطار يدخل هذا الكتاب (بو طليحية) لمؤلفه المحقق محمد النابغة الغلاوي الشنقيطي، فإن هذا الكتاب يعتبر بحق رائداً في هذا المجال، لما قام به مؤلفه من تقسيم جيد دقيق للكتب الفقهية التي ألفت في مذهب إمام دار الهجرة مالك بن أنس رضي الله عنه. بتمييز ما يعتمد في الفتوى منها مما لا يعتمد عليه.
هذا بالإضافة إلى بعض القضايا المهمة التي تحتاج إلى بيان كمسألة الاجتهاد والتقليد وأهلية من يقوم بالإفتاء، ومن تصح منه ممن لا تصح له أو منه.
ولقد قام الشيخ يحيى بن البراء بتحقيق هذا الكتاب تحقيقاً علمياً حيث قان بتصحيح الكتاب وتنقيحه، وشرح ما فيه من المصطلحات الفقهية والأصولية والنحوية وغيرها، والتعريف بالأعلام الواردة أسماؤهم في النص المحقق.
