بمقتضى الفقرة الأخيرة من المادة 171 من القانون رقم 328/ 2001 يعتبر الحكم الغيابي غير المبلغ آخر معاملة قضائية، ويبدأ منذ صدوره سريان مهلة مرور الزمن على دعوى الحق العام، خلافاً لما تنص عليه الفقرة المضافة من المادة 162 عقوبات، بإعتبار أنّ هذه الأخيرة لا تقضي بوقف مرور الزمن على دعوى الحق العام بمجرد صدور حكم في الدعوى فلا يعود يسري إلا وفاقاً للأحكام التي ترعى مرور الزمن على العقوبة.

مرور الزمن على الحكم 163 وما يليها، مرور الزمن على الأحكام القاضية بعقوبات منصوص عنه في قانون العقوبات وهو غير مرور الزمن على الدعوى العامة. - (قرار الغرفة 4 رقم 188 تاريخ 1969/10/7 - عاليه 50- 70- صفحة 491 رقم 1857).
