في هذا الكتاب تتناول الدكتورة عائشة الشرقاوي المالقي تجربة البنوك الإسلامية (بين الفقه والقانون والتطبيق) فجاء البحث فيها يتسم بطابع قانوني واقتصادي مع خلفية دينية وأبعاد سياسية واجتماعية. وهذا يقتضي من الباحثة نظرة حول الهيكل العام الذي تعمل "البنوك الإسلامية" من خلاله، والتي جاءت أصلاً لبتلور مبادئه وتعاليمه، وتعني به هيكل الإقتصاد الإسلامي الذي تعد هذه البنوك من ركائزه الأساسية في التطبيق. وتحاول في التطبيق إثبات هوية خاصة بها بحيث حلت محل البنوك التقليدية. تعتبر الباحثة أن البنوك الإسلامية اتخذت من قضية الفوائد وسيلتها الأساسية للوصول إلى هدفها. من هنا تفرض هذه الوضعية طرح عدة أسئلة ".. من الناحية الدينية، هل لهذه البنوك أساس نظري إسلامي؟ وهل استطاعت تطبيقه إن كان موجوداً فعلاً؟ ومن الناحية القانونية، هل هي بنوك فعلاً في المفهوم القانوني؟ ومن الناحية الإقتصادية، ما هو دورها في عملية التنمية، وكيف تؤديه؟...". تجيب هذه الدراسة عن مجموع هذه الأسئلة الإشكالية والتي تتمثل في إمكانية هذه البنوك بأساسها النظري وأدواتها في العمل، أن تكون بديلاً كاملاً للبنوك التقليدية أم لا؟ وهذا ما حدا بالباحثة إلى توخي الدقة في العمل والبحث في الموضوع من جيمع جوانبه (الفقهي – الديني- القانوني) لأجل ذلك قسمت الدراسة إلى قسمين: يتحدث (القسم الأول) عن الوضعية القانونية لتأسيس وإدارة "البنوك الإسلامية"، أما (القسم الثاني) فيتحدث عن أدوات التوظيف التي تعمل بها "البنوك الإسلامية". وأخيراً خاتمة ونتائج الدراسة...
