المشكلة التي يعالجها الباحث أحمد حسين يعقوب بسيطة وشائكة في آن ومفادها: هل في اجتهاد في المسائل التي يحسم القول فيها نص شرعي، من القرآن الكريم أو السنة النبوية الشريفة؟ أو هل من إعمال للرأي الشخصي في المسائل التي قام فيها النفس الشرعي منذ أن كان رسول الله صلى الله عليه وسلم على فراش المرض؟ ولماذا تغلب هذا الاتجاه لدى أصحاب السلطان طوال التاريخ الإسلامي؟
وفي سبيل تحصيل هذه المعرفة وتقديمها، حدّد الباحث معنى الاجتهاد لغة واصطلاحاً، وميزه من الفقه والتأويل ثم بين حدوده، فإن يكن الاجتهاد يعني بذل الجهد، ما أمكن في سبيل تحصيل معرفة بالحكم الشرعي من أدلته، فإنه غير ذي موضع عندما تكون هذه المعرفة موجودة ومتمثلة في نص شرعي، فعندما ينصّ الشارع على الحكم ينتفي وجود الاجتهاد بمعناه المعروف لدى علماء المسلمين. وبعد أن يعرف الباحث الاجتهاد، ويبين حدوده، يعود إلى التاريخ الإسلامي، ويقرأ وقائعه منذ أيامه الأولى وإلى أيامنا هذه، ويتبين مظاهر العمل بالرأي/الخروج عن النص الشرعي وأسباب ذلك ونتائجه في بابين يبحث أولهما في المفهوم التاريخي للاجتهاد، من حيث معناه، والقوى التي وضعته، وأهدافها من وضعه، ووسائلها في سبيل سيادته... ويبحث ثانيهما في الواقع الذي قام بعد أن ساد مفهوم الاجتهاد وبمعنى العمل بالرأي في مقابل النص، إذ عرف التاريخ الإسلامي وجود مرجعيتين ورئاستين: أولاهما، صاحبة السلطان، وهي فعلية واقعية، وثانيتهما معارضة تستند في معارضتها صاحب السلطان إلى شرعيتها... ويتتبع الباحث في بابي كتابه، مسار التاريخ الإسلامي، بغية تلمُّس إجابات وافية للأسئلة التي يثيرها موضوع بحثه، ويخلص إلى نتائج يعرضها بأسلوبه الواضح السهل.
