يحاول د. عبد الأمير زاهد في هذا الكتاب أن يجيب عن هذه الأسئلة العامّة، وأسئلة أخرى كثيرة تتفرع عنها، فيمهِّد ببحث عن القانون في التشريعة الإسلامية وأدلّته ثم يبحث في ثلاث قضايا مركزيَّة هي: القانون الدولي الإسلامي، وجوهر القاعدة القانونيَّة الدوليَّة في الإسلام، والمصادر العامَّة للقانون الدولي في الإسلام.
وينتهي إلى تركيز النتائج التي توصَّل إليها، ومنها أن الفقه الدولي الإسلامي نسيج متماسك في إستجابته وإحتوائه لقواعد القانون الطبيعي والقواعد الأخلاقية، في حين أنَّ الفقه الدولي الوضعي يضع الحواجز مثلاً (يختلط) بنمط القاعدتين، ويعجز عن ذلك بسبب ضغط الحقائق الإجتماعية على عملية التقنين الدولي لإقراره بمصدريَّة العرف الدولي منشأً لأحكامه.
