"التحقيق الجنائي" كتاب نال به مؤلفه درجة الدكتوراه في الفقه الإسلامي وأصوله من كلية الشريعة في جامعة دمشق برتبة امتياز، ويأتي ضمن مشروع (مئة رسالة جامعية سورية) التي تعنى دار النوادر بنشرها.
أثبتت التجارب الإنسانية أن القانون الوضعي أَعْجَزُ من أن يستطيع كبح جماح الجريمة التي استشرت لدى جميع المجتمعات ـ سواء منها المتحضرة، وغير المتحضرة ـ، وإيقاف ما تسببه من رعب يهدد أمن المجتمعات واستقرارها.
افتتح المؤلف كتابه بذكر أقسام القوانين في الشرع الإسلامي، ثم بين معنى الدعوى الجنائية العامة والخاصة، وبين أركان الدعوى، وشروطها. ثم ذكر المواصفات التي يجب أن يتحلى بها المحقق الجنائي من عدالة، وأمانة، وذكاء، وفطنة، وغيرها. ثم عقد فصلاً في إجراءات التحقيق الجنائي، وذكر فيه مبادئ التحقيق من فتح المحضر، وتدوين الإجراءات، وغير ذلك، وذكر ـ أيضاً ـ مباحث متعلقة بهذا الموضوع كأساليب استجواب المتهم، وحبسه على ذمة التحقيق، وغير ذلك.
ثم ذكر آثار الشهادة في التحقيق، وشروط الشاهد، وكيفية ضبط الشرع للشهود الذين تقبل شهادتهم، وختم بالكلام عن اليمين، والقِسَامة، وأثرها على مجريات التحقيق.
