يحضرني وأنا أقدم لهذا الأمر أن اذكر أنني كتبت ورقة بحثية قدمتها لأستاذنا الفاضل الدكتور مصلح الطراونه حاولت أن أشير فيها إلى بعض الأفكار وبعض الآراء النيرة لبعض من الفقه المعاصر وخاصة فيما يتعلق بالشروط المطلوبة في المحكم والقاضي وفقا لفقه السلف في إشارة إلى واقع اليوم. وكان هناك تطرق لمسألة الإحالة على قواعد الشريعة الإسلامية كقواعد مطبقة على النزاع التحكيمي وتناولنا الحديث عن قضايا عملية لم تسفر عن تطبيق مثل هذا الشرط أمام هيئات تحكيم ترى أنه شرط منطو على جهالة وبدأ التساؤل…… هل ما يقال في هذا الخصوص له ما يبرره؟
من هنا ولدت فكرة هذا البحث ولكنها كانت فكرة مصحوبة بخوف من الإبحار في محيط الفقه الإسلامي الذي قيل فيه أنه بحر لا ساحل له، مع خشية من كل تلك اللغة الرصينة والتي يصعب فهم بعض مصطلحها، ولكن المضي والعزم مع التشجيع من غير واحد من أساتذتنا الإجلاء دفعني للمضي.
وفي بداية هذا البحث اعتقدت أن هناك مشكلة في التأصيل ستواجهني، غير أنه كان لجهود من قبلي في التأصيل لآراء الفقهاء في مسألة التحكيم خير معين على تسهيل مهمتي، وكان للجهود الجبارة في حركة التجديد في الفقه الإسلامي بعد منتصف القرن الماضي الأثر البالغ في أن يكون كل ذلك عونا لي، وما الموسوعة الفقهية الكويتية إلا خير شاهد على تلك الجهود المباركة، فكنت كلما أردت التأصيل رجعت إليها دليلا ومرشدا يدلني إلى أمهات الكتب وأحيانا كان فيها من الوضوح ما يغني عن الرجوع لأمهات الكتب القديمة، حيث كان الرجوع إلى أمهات الكتب لغاية التمعن والتدبر في الرأي الفقهي.
