مهما كان مصدر التشريع وأيا كان المشرّع، فالتشريع هو مجموعة من القوانين والقواعد والأسس التي يضعها المشرع لتنظيم العلاقات الإنسانية الظاهرة بين الأفراد والمجتمعات، وبيان ما لهم من حقوق، وما عليهم من الواجبات. يتضمن هذا الكتاب دراسة مقارنة في المنهج والإجتهاد وضعها الشيخ حسن أحمد الهادي بهدف تتبع حركة التشريع في الإسلام منذ بدايته ببعثة النبي محمد (ص) بالرسالة؛ ومصادرها ومراحلها، دون إغفال لما وقع من اختلافات سياسية بعيد وفاة النبي (ص) وآثارها على حركة التشريع والشريعة. وبناء على ذلك يبحث الكاتب في عصر النبي (ص) باعتباره عصر التشريع، بمعنى إيجاد الشريعة فحسب. وأما العصور الأخرى فيكتفي فيها بتناول كليات حركة التشريع الإسلامي في عصور أئمة أهل البيت بيانا وشرحا وتفصيلا، ولا سيما في عصر الإمامين محمد الباقر وجعفر الصادق باعتبار أن هذا العصر - برأي الكاتب - عصر إحياء الشريعة الإسلامية بأصولها وفروعها ... إضافة إلى أن هذا العصر شهر التطور المنهجي للفقه المأثور والتفريعي أي حركة الإجتهاد في عصر الغيبة ...
قسّم الكتاب إلى ثلاثة أبواب تناول الأول منها التشريع الإسلامي في العهد النبوي، والثاني: وتدور أبحاثه حول دور الخلفاء ويقصد بهم الكاتب، أئمة أهل البيت في تعاملهم مع الشريعة، وأما الباب الثالث والأخير فيتناول أهم أدوار التشريع والفقه عند السنة، ابتداء بحركة الصحابة عليهم السلام مرورا بنشوء المذاهب، وتدوين الحديث، وصولا إلى مرحلة الركود والتبعية ... .
