إن الله قد خلق الإنسان وأودع فيه غرائز متعددة يسعى لتحقيقها منها: حُبُّ الذات وحب التملك وحب السيادة وحب الشهوات، ونتيجة لذلك تنشأ الخلافات والصراعات، وحتى تستمر الحياةُ شَرَعَ الإسلام الأحكام القضائية من أجل فض النزاع وإنهائه، فالأصل في فض النزاعات القضاء، إلا أَن حُكْمَ القضاء وإن كان يؤدي إلى حسم المنازعة من الناحية القانونية، فإنَّه ـــ في أغلب الأحيان ـــ لا يؤدي إلى حسم النزاع من نواحيه الاجتماعية، بل قد يزيد من حِدّة التوتر، والإسلام لم يَقِف عند هذا الحد في إنهاء الخصومة بل شرع أمراً آخر أطيب للنفوس، وأدعى للقَبول والرضا، وأبعد عن الحقد والكراهية، ألا وهو الصُّلح.
