قدر للعراق ان يقع تحت احتلال أجنبي آخر، وقدر لبغداد أن تشهد دخول قوات غازية مرة أخرى في تأريخها وما صاحب هذا الدخول من تداعيات مختلفة على المستوى الداخلي والدولي، وبعد التاريخ المذكور بدأت محاولات سياسية لإعادة بناء الدولة ربما على أسس واعتبارات مختلفة قد تقود إلى فشل أو نجاح هذه التجربة وهو أمر متروك للمستقبل. ومن الأسس التي نستطيع عدها بمثابة الخطوة الاولى في الاتجاه المذكور التجربة التي قدر لها أن تتمخض عن كتابة أول دستور عراقي دائم في ظل نظام حكم جمهوري منذ تاريخ انهيار الملكية صبيحة الرابع عشر من تموز عام 1958.
لقد تضمّن الدستور العراقي النافذ عام 2006 الإشارة إلى ضرورة قيام مجلس النواب وهو السلطة التشريعية باعداد وصياغة أكثر من خمسين قانوناً جرت الإشارة اليها في مواد الدستور المتعددة، وإذا كانت المكتبة القانونية في العراق تعاني نقصاً في الكتابات أو المؤلفات القانونية الأساسية، ونحن لا نبالغ عندما نقرر النتيجة المتقدمة فان هذا النقص يمتد كذلك ليصل إلى فروع القانون المختلفة سواء كان الأمر متعلقاً بجوانب قانونية موضوعية أو شكلية ومن هنا تبرز الحاجة لهذه الدروس أو الأفكار التي نعتقد انها ضرورية لكل شخص يتصدى لعملية التشريع، فما سنتعرض له أو نحاول أن نعبر عنه في هذه السطور لن يكون مجرد نقاط أو نصائح مباشرة ربما يطغى عليها الجانب الشكلي وتكون متعددة عن الجوانب الموضوعية لفكرة القانون ذاته، فاذا سلمنا ان النص بشكله الذي ظهر فيه انما يكون قد عبر عن مجموعة من الحقائق أو الأسس أو الاعتبارات تمثل جوهر النص القانوني أو القاعدة القانونية التي يتضمنها هذا النص فالقوانين كما يقول الفقيه سافيني تخرج من فطرة الشعوب واحتياجاتها كما يخرج النبات من الأرض، مع ضرورة ملاحظة ان القوة الحقيقية في أي مجتمع للذين يملكون المصالح الحقيقية فيه.
