إن القانون الدولي هو مجموعة القواعد التي تنظم العلاقات بين الدول ذات السيادة ولا تعترف بأي سلطة أعلى منها. فالقانون الداخلي قانون طاعة وامتثال، يهيمن على الأشخاص الذين يمكن إرغامهم على احترام القانون بطريق القوة إذا اقتضى الأمر، أما القانون الدولي، فإنه على النقيض من ذلك، يعدّ قانون تنسيق يكتفي بتحبيذ التعاون بين الدول.
لقد كانت الدول وحدها أشخاص القانون الدولي التقليديين، أما اليوم فقد ازداد حجم النشاطات الخاصة ذات المرمى العام، واصبح الرأي العام عنصراً هاماً في العلاقات السائدة بين الحكومات. وقد أثير الجدل في يومنا هذا حول الصبغة العالمية للقانون الدولي إذ أنه يتأرجح بين مبدأي سيادة الدول وتنظيم المجتمع الدولي؛ كما أخذت المذاهب المتعارضة تتجابه في هذا الشأن.
وتسهيلاً للدراسة، قدمنا تباعاً هذا الموضوع الشيق في قسمين، قواعد المجتمع النسبي وقواعد المجتمع المبني على المؤسسات. ولكن يجب ألا يغرب عن بالنا أن هذين المجتمعين متداخلان في الواقع ولا يمكن استبدال الأول بالثاني، لأن الدول نفسها متصلة بكلتيها.
وهذا الكتاب يرمي إلى استنباط أوجه التداخل الرئيسية بين هذين المجتمعين بأسلوب مفعم بالواقعية والوضوح ليجعل هذا الموضوع الهام في متناول الحقوقيين والقانونيين والمثقفين في العالم العربي كافة.
