Book Description
إن أبواب المعاملات من أهم الأبواب الفقهية التي عني بها فقهاء المسلمين قديماً وحديثاً؛ وذلك لأهميتها ومدى الحاجة إليها، فهي التي تنظَّم معاملات الناس فيما بينهم، وتضع لهم القواعد والأحكام التي ينبغي عليهم أن يأخذوا بها في مختلف تعاملاتهم من تجارة وصناعة وزراعة، وغير ذلك.
وقد ندب الشرع الشريف إلى التيسير على الناس، ورفع الحرج عنهم ما لم يكن في ذلك إثم، وعلى الرغم من وجود دراسات وكتابات عن قضية التيسير بصفة عامة، إلا أن أحداً من الذين كتبوا فيها لم يخص دراسة التيسير في المعاملات بوجه خاص.
لذلك مما يميز هذه الدراسة الذي بين أيدينا أنها تقارن بين مدرستين فقهيتين، الأولى: تمثل مدرسة الرأي والنظر، والثَّانية: تمثل مدرسة الحديث والأثر، وقد تميز كل منهما العديد من جوانب التيسير... مما يعزز القول بأن المذاهب الفقهية تتنوع مشاربها وآلياتها، وتتوحد أهدافها وغاياتها، فالغاية هي فهم مقاصد الشريعة الإسلامية وقواعدها الكلية وإسقاط ذلك على الجوانب التطبيقية.
وقد جاء الجانب النظري في هذه الدراسة شاملاً أسباب التيسير وضوابطه، على حين جاء الجانب التطبيقي ليوضح أهم مظاهر ذلك التيسير عند الأحناف في النظرية التي تفرق بين الفساد والبطلان والتي تصحح الكثير من العقود والمعاملات، وفي نظرية العقد عند الحنابلة التي تمنح المتعاقدين الحرية في إستحداث العقود ما لم يخالف ذلك نصّاً قطعياً أو مقصداً أساسيّاً، وهي النظرية التي سبقت النظريات القانونية الحديثة فيما عرف بمبدأ سلطان الإرادة.
