كما إن علم الفقه، بالرغم من تاريخه المديد، إلا أنه لا يزال يعتبر من جملة العلوم المتحركة والمتطورة، ويواكب حركة الحياة الإجتماعية والسياسية والإقتصالدية وغيرها. ولذا تجده لا يزال يقرر الفتاوى والأحكام القدمية والحديثة اعتماداً على ما يستنبطه من المصادر الأساسية في القرآن الكريم والسنّة الشريفة.
