أثار إستظهار القصد الجنائي في جريمة القتل العمد من المشكلات العملية ما لم يظهر في أية جريمة أخرى، يضاف على ذلك الخلاف الفقهي حول طبيعة القصد المتطلب في القتل العمد.
ومن هنا، كانت الصعوبة في هذا الموضوع، فالدراسات التي تناولت القصد الجنائي لا تزال غير كثيرة وأغلبها إن لم تكن جميعها تناولت القصد الجنائي كواقع حال، وبالتالي لا توجد دراسة خاصة عنيت في كيفية إستظهار القصد الجنائي وخصوصاً قصد القتل بحيث تحيط بالموضوع من جوانبه المختلفة.
ولا نعدو الحقيقة في قولنا أن ما كتب في هذا المجال جاء ضامراً لا يتعدى صفحات قليلة تناولت الموضوع بصورة مقتضبة لم توفيه حقه، ويمكن ان نعزو ذلك إلى صعوبة إستظهار وكشف الحقائق النفسية والمعنوية، الأمر الذي قلل من إقبال الباحثين على دراسة هذا الموضوع، والذي أنعكس بدوره على شحة المراجع والمصادر المتعلقة بهذا الموضوع، لذا كان لزاماً علينا جمع شتاته من شذرات متفرقة في مختلف المراجع معززين تلك الشذرات بالإجتهادات القضائية الصادرة في هذا الخصوص.
من هنا، جاء هذا المؤلف كلبنة أساسية في النظرية العامة للقصد الجنائي وفي المجالين العملي والنظري.
