Book Description
يعبر لفظ القانون، بمعناه العام، في كل المعلوم، عن النظام والاستقرار، والعلاقة الثابتة والدائمة بين الظواهر، أي تكرار حدوث الظاهرة كلما توافرت مسبباتها.
ويقصد بالقانون، في اللغة القانونية، مجموعة قواعد السلوك العامة الملزمة للأفراد في المجتمع، والتي تنظم العلاقات والروابط، ويناط كفالة احترامها من خلال الجزاء الذي توقعه السلطة العامة على مت يخالفها.
ويطلق اصطلاح القانون أحياناً للتعبير عن مجموعة معينة من القواعد القانونية التي تصدر عن السلطة التشريعية، أي أن القانون يستخدم هنا للتعبير عن التشريع، فيقال قانون الإثبات، وقانون الأحوال الشخصية، وقانون خدمة الدفاع الوطني.
ويستخدم لفظ القانون كذلك للدلالة على مجموعة القواعد القانونية التي تنظم نوعاً معيناً من الروابط، وتعتبر فرعاً معيناً من فروع القانون، فيقال القانون المدني للدلالة على مجموعة القواعد القانونية التي تنظم العلاقات المالية بين الأفراد، والقانون التجاري للتعبير عن مجموعة القواعد التي تحكم العلاقات التجارية أي العلاقات بين التجار، وقانون العقوبات الذي يقصد به القواعد التي تحدد الجرائم وتعين العقوبات عليها.
وأخيراً فإن القانون كثيراً ما يقترن بلفظ آخر وهو "الوضعي" للتعبير عن القواعد السائدة والمطبقة فعلاً في بلد معين، فيقال القانون الوضعي اللبناني للدلالة عن مجموعة القواعد القانونية المطبقة بالفعل في لبنان في الوقت الراهن ونفس الحال بالنسبة للقانون الوضعي المصري.
