لقد أنزل الله تعالى شريعة الإسلام على محمد صلى الله عليه وسلم لتبقى، لا لتزول، ولكي تبقى لا بد من أن تتوفر فيها القدرة على التطور في الأحكام الذي يمكِّنها من ملاحقة التطور الحضاري بمعطياته الجديدة.
وحتى تكون الأحكام منضبطة غير تابعة لأهواء المجتهدين، فإنه لا بد من أن يخضع الإجتهاد، في إصدار الأحكام للقضايا المستجدة، إلى ضوابط ثابتة ومنهج واضح يتسم برد المسائل المستجدة إلى أصلٍ أو عَقْد عرفته الشريعة، وتعامل به الفقهاء، ولما كان الفقيه لا يستطيع أن يحيط بدقائق العلوم التي يحتاج إليها لإصدار الأحكام الشرعية في المسائل المستجدة التي تشكل هذه العلوم لُبَّها، فقد كان لا بد من اللجوء إلى مؤسسات الفتوى التي تجمع بين الفقهاء في الشريعة والعلماء في المعاملة المستجدة المطروحة للبحث، إقتصادية كانت المسألة أو طبية أو غير ذلك، حيث يعطي هؤلاء العلماء فقهاء الشريعة التصور الصحيح للمعاملة المستجدة، ثم يصدر علماء الشريعة الحكم الذي يرون أن الشارع قد تلمَّسه لهذه المعاملة المستجدة، لأن الحكم على الشيء فرع عن تصوره.
ولقد جمع المؤلف مادة هذا الكتاب مما حضره من المؤتمرات والندوات العملية المتخصصة التي تعالج قضايا معاصرة، ومن أبحاث قدمها علماءٌ أجلاءٌ إلى المجامع الفقهية، ومن محاضر مناقشاتهم لهذه الأبحاث، ومن الرسائل العلمية من ماجستير ودكتوراه، التي ناقشها أو أشرف عليها، عالج فيها أصحابها مسائل مستجدة.
