تناولت هذه الدراسة موضوع (أحكام الوقف في ضوء المصالح المرسلة) وهو موضوع في غاية الأهمية، لانّ الحاجة ماسة لبيان أثر المصلحة المرسلة في الأحكام المتعلقة بالوقف، وأثرها في إستحداث صور جديدة للوقف، وهذا يقتضي بيان معنى الوقف وأنواعه وأدله مشروعيته، والمصلحة المرسلة ومعناها وأدلة مشروعيتها وأنواعها، وأثر المصلحة المرسلة في أحكام الوقف.
كما أن هذه تشير إلى ضرورة رعاية ناظر الوقف والواقف والحاكم والقاضي والمفتي في الحديث عن أحكام الوقف، وعدم الوقوف عند بعض الآراء الفقهية القديمة.
وإن معطيات العصر الحاضر وما أفرزه من تطور في شتى مجالات الحياة المعاصرة تقتضي إعادة النظر في بعض الأحكام المتعلقة بالوقف، وفتح المجال لتوسيع دائرة الوقف في إستحداث صور جديدة ومعاصرة تمشياً مع إفرازات هذا العصر بما يتوافق وروح الشريعة الإسلامية الغراء، وهذا أحد مقاصد هذه الرسالة.
