Book Description
بين يدي القارئ شرح الخرشي على مختصر خليل. أما المختصر فهو للشيخ أبي الضياء خليل بن إسحاق، وهو من أشهر متأخري المالكية، وكتابه المختصر أعظم ما صنف في الفقه المالكي من المختصرات وأغنى عن كثير من المطولات، كما يقول شارحه الخرشي في مقدمة شرحه كما سيوافيك.
وأما الشرح فهو لأبي عبد الله محمد بن عبد الله الخرشي المالكي، ويكاد شرح الخرشي يكون أشهر شرح على مختصر خليل، ورغم أن شروحه بلغت مع الحواشي العشرات، وسيجد القارئ مئات النقول منها في طيات الشرح وحاشيته. جاءت حاشية الشيخ علي العدوي على الخرشي، أما سبب وضع الشارح لهذا الشرح الذي هو بين يدي القارئ فيبينه الخرشي قائلاً: "أدركتني رحمة الضعاف فثنى عنان القلم إليهم حب الإسعاف حين طلب مني جماعة من الإخوان، وجملة من الخلان شرحاً (غير شرحه الكبير) لا يكون قاصراً عن إفادة القاصرين، خالياً عن الإطناب وعما يصعب فهمه من الإيجاز على المبتدئين، ليعم نفعه العباد، ويتعاطاه الخضري والباد.
ومن ميزات هذه الخاشية كثرة النقول عن باقي كتب المالكية مختصرات ومطولات، وقد جرى فيها على عادة كثير من المحشين على طريقة القول، فهو يأتي بطرف من كلام المصنف أو الشارح ثم يعلق عليه، إما تفسيراً وتوضيحاً وإما ربطاً بما تقدم أو بما سيأتي، كما اعتنى ببيان الوجوه البلاغية والإعرابية التي تضيء المختصر وشرحه. ولم تخل الحاشية من مناقشات كثيرة خاصة مع بقية الشراح والمحشين على المختصر. وذكر الأقوال والوجوه والاختيارات، وتفصيل المجملات والنظر في كثير من الفروع. كما أن الحاشية مشحونة بالفوائد اللغوية وغيرها. وكثيرة الاستطراد على طريقة التنبيه. ويظهر فيها بوضوح نفس الاستقصاء.
وبالجملة فهذان كتابان يتيحان للقارئ ولدارس الفقه نظرة تفصيلية عن الفقه المالكي، فعسى أن يجد من يطالع فيه ضالته. وهو بعد ذلك من آثار تراثنا الذي ينبغي الحرص على نشره. وقد اعتمد في هذه الطبعة على نسختين مطبوعتين جعلت الطبعة القديمة هي الأصل، فأصلح ما فيها من أخطاء، واستفاد من الطبعة الأخرى وهي جديدة نسبيا لضبط بعض الكلمات المطموسة في الأصل القديم، ولتنظيم إخراج الكتاب. كما خرج الآيات القرآنية والأحاديث الشريفة، وعلق على بعض المواضع، حيث تعلق الأمر باستدراك في النقل وغيره، كما لم يغفل تخريج الشواهد الشعرية -على قلتها- أما ترجمة الأعلام فقد تكفلها المحشي.
