في جميع الإجراءات التي تتعلق بالأطفال ، سواء قامت بها مؤسسات الرعاية الإجتماعية العامة أو الخاصة ، أو المحاكم أو السلطات الإدارية أو الهيئات التشريعية ، يولى الإعتبار الأول لمصالح الطفل الفضلى . ( إتفافية حقوق الطفل المادة 3 الفقرة 1 ) .
مصالح الطفل الفضلى تعني تحقيق وضمان التمتع الكامل والفعلي بجميع الحقوق المعترف بها في اتفاقية حقوق الطفل ، والبرتوكولات الملحقة بها ، وضمان النمو المتكامل الأمثل للطفل .
وتُعد مصالح الطفل الفضلى حقاً أساسياً للطفل ، ومبدأ قانونياً عاماً توجيهياً يتوجب أن يطبق في جميع المواقف ويُسترشد به في كافة الإجراءات التي تؤثر على الطفل ، وهي المعيار بصحة أي إجراء يتعلق بالطفل أو يؤثر فيه ، كما إنها المحور الذي تدور حوله كافة الحقوق المقرة للطفل دولياً وداخلياً ، والمبادىء العامة للإتفاقية ، وبالتالي فهي الفلسفة الأساسية لاتفاقية حقوق الطفل .
وبسبب الإجماع العالمي على الإتفاقية ، فإن المصالح الفضلى للطفل أصبحت تعتبر قاعدة آمرة من قواعد القانون الدولي ، فلا يجوز التنكر لها أو إبرام معاهدات مناقضة لها أو إقرار قوانين تخالفها ، بل هي هدف أساسي ينبغي أن تستهدفه سائر الشعوب عبر اتخاذ الإجراءات الفعالة لضمان مراعاة مصالح الطفل الفضلى وتحقيقها .
