لقد شهد وطننا العربي في الآونة الأخيرة تطوراً ملحوظاً في أعمال الإنشاءات وخاصة في مجال إنشاء المباني والطرق والجسور وغيرها، ورافق هذا التطور في قطاع الإنشاءات إزدياد حجم الخلافات بين أرباب العمل والمقاولين والمهندسين، هذه الخلافات ناجمة عن عدة عوامل منها ما هو خارج عن إرادة المتعاقدين ومنها ما هو ناتج عن أخطاء وقع فيها أحد المتعاقدين، وأدى ذلك إلى إلحاق الضرر بالطرف الآخر.
ومن خلال بحث كل من المقاول ورب العمل عن السرعة في إنجاز الأعمال وحل الخلافات الناجة بمناسبة تنفيذ هذه الأعمال، وبالتالي حصول كل منهم على مبتغاه الذي يرتجيه من إبرام عقد المقاولة الإنشائية وللوصول إلى ذلك، لا بد من حل هذه المنازعات بسرعة بعيداً عن إجراءات التقاضي التي توصف بالبطء الشديد.
هذا بالإضافة إلى وقوف القوانين الداخلية عاجزة عن تلبية الإحتياجات الخاصة بذلك نظراً، لأن هذه القوانين أصبحت قديمة بعض الشيء حيث تعجز نصوص هذه المواد في كثير من الأحيان عن تسريع سير عجلة العمل الإنشائي نظراً لما تتحلى به من تعقيدات الروتين، مما حدا بوزارة الأشغال العامة الأردنية إلى إعلان عقد المقاولة الموحد فيديك 99 حيث أصبح يستخدم هذا العقد في مشاريع الإنشاء.
وهذا ما دفعني للكتابة في هذا الموضوع، حيث سنتناول بالدراسة هذا العقد داخل الدولة على إعتبار أن أطراف العقد هما وطنيان أي من داخل الدولة وسنحاول من خلال هذه الدراسة الإستشهاد بالقوانين الداخلية وسنذكر التعارض بين نصوص الفيديك وما بين نصوص قوانين الدولة ذات العلاقة إذا وجد مثل هذا التعارض، وذلك حتى نتأكد من أن عقود المقاولة الإنشائية فيديك 99 منصفة وعادلة ما بين الأطراف دون أن ترجح كفة أحدهم على الآخر وهذا لا يكون إلا من خلال الإلمام الجيد بما يحتويه عقد المقاولة الإنشائية فيديك 99 من حقوق وإلتزامات ومطالبات لكل من رب العمل والمقاول وكذلك مطالبات التي يستطيع كل منهما الرجوع بهاف على الطرف الآخر.
