تعدّ دراسة ملاكات الأحكام، ومحاولةُ تأسيس نظريّات شرعيّة بنيويّة في مجالها، من أهمّ وأروع الدراسات التي تشتمل عليها فلسفة الفقه، ومع ذلك نجد الموقف من مثل هذه الأبحاث يتّسم بالمراوحة بين الثناء والإحجام عن الخوض.
ويعود ذلك إلى إشتمال هذه الدراسات على مخاطر التورّط في القياس وغيره، ممّا يدعو الفقه الإماميّ إلى تركه وإجتنابه في البحث الفقهيّ... ولكن إذا كان الهدف من فلسفة الإجتهاد هو الإجابة عن تساؤلات الفقه الأساسيّة والفرعيّة، فلا بدّ من إنعام النظر في المباني الفقهيّة ومحاولة التنقيب عن أهداف الأحكام ومصالحها.
كما لا بدّ من بناء قواعد ونظريّات جديدة على ضوء تلك المباني؛ بحيث تقوم بتكريس آليّات تساهم في تفسير الأحكام وتبرز مدى فاعليّة الفقه ومرونته وقدرته على التطوّر، والعقل واحد من الآليّات التي يمكن إعتمادها في هذا المجال.
وذلك من خلال توظيف العقل المستنِد إلى النصّ، للكشف عن مصالح الأحكام ومقاصد الشارع من وراء بعض الأحكام ليكون هذا الإكتشاف هادياً للفقيه خلال دورة عمله الفقهيّ...
