والفقه المقارن يعني: أن تعرف أقوال المذاهب في المسألة من الفروع الفقهية، وأن تتعرف على أدلة هذه المذاهب في تلك الفروع، ووجه إستدلالهم بها، ومناقشة تلك الأدلة ووجه الإستدلال بها، ليتوصل إلى مناقشة الأقوال في المسألة، وترجيح ما يظهر للباحث المتمكن - الذي توفرت فيه شروط الترجيح - أنه أقرب إلى الصواب من تلك الأقوال.
