وقد كان عرض هذه المواضيع وفقاً لمستجدات العصر العلمية والثقافية والاجتماعية، مع إبداء رأي القدامى والمتأخرين من الفقهاء فيها، مما شكل رؤية للمشكلة في إطارها التأصيلي القديم وروح المعاصرة، بما يتفق مع القواعد الشرعية، ومقاصد التشريع التي كان أساسها المصلحة من جلب المنافع ودرء المفاسد.
