كتاب فريد يبحث في أهم مسألة أصولية بعد الاجتهاد، ألا وهي أحكام التقليد. حبَّرته يراعة الإمام العلامة السيد الشريف علي السمهودي نزيل المدينة المنورة. وضعه مصنفه على عشر مسائل أُمَّات، أحاطت بأبرز ما يبحث في حكم التقليد. عرض فيه لبيان معنى التقليد، ومعرفة المقلِّد، وطبقات المقلدين. مع تحقيق القول في تخيِّر الأقوال عند استوائها أو تباينها، وهل للمقلِّد حق الخيار في ذلك. ثم بحث في جواز تقليد الميت في المجتهدين، وتصحيح الحكم بذلك. وهل للمقلِّد أن يُستفتى فيفتي بقول المجتهد وشرط ذلك.
ثم بيَّن حكم تقليد المجتهد الميت إن ترك قولين في مسألة: هل يجوز الإفتاء بهما والعمل، أو لا بد من الترجيح. ومما بحث فيه كذلك حكم التزام مذهب معين بعد تدوين المذاهب المعتبرة، وحكم الانتقال منه لغيره، وشروط وضوابط ذلك. وهو من أهم مباحث هذا الكتاب. كما تصدى للحديث عن الاعتراضات والإشكالات التي تُوجَّهُ للقائلين به. فأظهر أقوال المعترضين، ثم ناقشها وفنَّد ملتبسها، وفصَّل القول في ذلك مع التحقيق، وبيان ما يتعلق بالتلفيق. إلى غير ذلك مما يعد من المهمات التي لا يستغنى عنها؛ كدفع الشبه التي أحاطت بموضوع التقليد.
وقضية التقليد اليوم من القضايا الشائكة، والتي كثر فيها قال وقيل. وهي بعد لا تزال غير بائنة لكثير ممن يطلق اللسان بالحديث عنها، وهو بعد غير متصور لرسومها وحدودها. وهذا يستدعي استنطاق ما قيل فيها. وقد حرصت دار المنهاج على نشر هذا الكتاب الفذِّ؛ نشراً للعلم والتوعية، وبياناً لأراء العلماء المعتبرين في القضية.
