بدأت الجهود الدولية لتنظيم وتقنين قواعد التجارة الدولية بشكل عام في النصف الثاني من القرن التاسع عشر، وإستطاع المجتمع الدولي تركيز هذه الجهود في شكل معاهدات دولية ثنائية وجماعية، تنظم حركة التجارة بين الدول أطراف المعاهدات.
ما زالت هذه الجهود مستمرة حتى اللحظة بهدف الإرتقاء بهذه القواعد لتواكب التطور التقني والتكنولوجي الذي وصل إليه الجنس الإنسان مؤخراً، إلى أي مدى نجح المجتمع الدولي في تنظيم قواعد ونظم التجارة الدولية، وما هي الأسس التي بنى عليها هذا التنظيم القانوني الدولي؟ سيكون هذا السؤال هو مدار البحث في هذه الدراسة المتواضعة.
تحوى هذه الدراسة خمسة أجزاء رئيسية، حيث تبدأ ببيان مصادر قانون التجارة الدولية المختلفة، وما هي مشتملات هذه المصادر وطبيعتها القانونية، ثم ننتقل في جزئها الثاني لبيان ماهية القواعد القانونية الدولية الناظمة لتجارة البضائع على المستوى الدولي.
أما الجزء الثالث نبحث في إتفاقيات منظمة التجارة العالمية من حيث: تطورها التاريخي وكيف توصل المجتمع الدولي إلى صيغتها الحالية والمواضيع التي تم ترحيلها للنقاش إلى دولة مفاوضات الدوحة؛ ماهية الإتفاقيات الرئيسية التي قامت عليها إتفاقيات منظمة التجارة العالمية.
وقد تم تخصيص الجزء الرابع من هذه الدراسة للبحث في أهم العقود التجارية المستخدمة على الصعيد التجاري لدولي، مثل عقود التوزيع ونقل التكنولوجيا والإمتياز والإستثمار التجاري الدولي... إلخ.
وأخيراً، تنتهي هذه الدراسة ببيان قواعد وأسس التحكيم التجاري الدولي وفقاً لما أقرته لجنة التجارة الدولية التابعة للأمم المتحدة، على إعتبار أن هذه القواعد هي الأكثر نجاعة في التعامل مع المنازعات التجارية الدولية، والأكثر إستخداماً بواسطة طائفة التجار.
