تتكرس أهمية هذه الدراسة بكونها دراسة رائدة قد عالجت فجوة قانونية متمثلة بفك الالتباس الذي قد يتبادر إلى الأذهان حول التكييف القانوني لسلوك الجاني بعد إتمام مشروعه الإجرامي، ولعلنا لا نغالي إذا ما قلنا بأن هذه الدراسة تعد من الدراسات القلائل التي تناولت موضوع سلوك الجاني اللاحق من زاوية قانونية شرعية، فمن خلال الإطلاع على الدراسات السابقة يمكن إدراك وجود حالة من الفقر الشديد في دراسة حالة التكييف القانوني للسلوك اللاحق للجاني، والأهمية العملية التي تقصدها هذه الدراسة والتي ما هي إلا جهد بسيط هدفها تبصير القضاء ووضع الحلول الملائمة – إن أمكن– لحالة السلوك اللاحق للجاني على إتمام جريمته. كما تأتي أهمية هذه الدراسة كونها ألقت الضوء على مسألة سَبق الشريعة الإسلامية في تناول هذا الموضوع عن القوانين الوضعية، إلا إن فقهاء الشريعة لم يستعملوا المصطلحات الحديثة المتعلقة بموضوع الدراسة كالتي عُرفت لدى شُرّاح القوانين الوضعية.
