كتاب "الاستبصار فيما اختلف من الأخبار" هو تلخيص لما جاء في كتاب سابق للطوسي هو "تهذيب الأحكام" الذي جمع فيه من الأخبار المتعلقة بالحلال والحرام، والمشتملة على أكثر ما يتعلق بالفقه من أبواب الأحكام. إلا أن هذا الكتاب بما فيه من الأحاديث والشروح جاء مطولاً، مما يثني المطلع والقارئ عن اللجوء إليه لضيق الوقت. لذا عمد المؤلف الطوسي إلى إعادة تأليفه. وبناء على ذلك جاء هذا الملخص ذاخراً بالمسائل الفقهية مع مراعاة إيراد الأحاديث المختلفة مفرداً على طريق الاختصار وبذلك يفرع إليه المتوسط في الفقه لمعرفته، والمنتهي لتذكره، مبتدئاً في كل باب بإيراد ما اعتمده من الفتوى والأحاديث فيه، معقباً بما يخالفها من الأخبار ومبيناً وجه الجمع بينها على وجه دون إسقاط شيء منها ما أمكن للمؤلف ذلك، مجرباً في ذلك على عادته في كتابه الكبير المذكور "تهذيب الأحكام"، مشيراً في أول الكتاب إلى جملة مما يرجح به الأحاديث بعضها على بعض، ولأجله جاز العمل بشيء منها دون جميعها، ومبيناً ذلك على غاية الاختصار حيث بإمكان من أراد التوسع الرجوع إلى الكتب المصنفة في أصول الفقه المعمولة في هذا الباب.
