لما كان الأئمة المعصومون عليهم السلام هم حجج الله سبحانه وتعالى في الأرض وخلفاء الرسول الأعظم صلى الله عليه وسلم على الأمة، يحفظون رسالته السمحاء، ويرعون شؤون الأمة من جوانبها كافة، الدينية منها والسياسية والاجتماعية والاقتصادية، اعتبروا عليهم السلام مصدراً من مصادر التشريع الإسلامي بعد الرسول العظيم صلى الله عليه وسلم. على هذا الأساس لجأ ففقهاؤنا الأجلاء إلى استنباط الحكام الشرعية من أقوالهم، وأفعالهم، وتقاريرهم، وتصرفاتهم عليه السلام.
وهذا هو الجزء الأول من مجموعة أجزاء ربما تتجاوز العشرة في موضوع الحسين عليه السلام، والتشريع الإسلامي، يتناول فيها المؤلف دور الإمام الحسين عليه السلام في التشريع الإسلامي بشكل مستدل، وموثق ومقارن، ومفلسف في آن واحد.
وهذا الجزء بكامله والجزء الذي يليه هما بمثابة التمهيد للموضوع، يبدأ فيه المؤلف ببحث كل الجوانب المتعلقة بالتشريع الإسلامي، من حقيقة التشريع مروراً بقيمة التشريع، وتاريخ التشريع، ودور الإمام الحسين عليه السلام في التشريع، وينتهي بمصادر التشريع، والشرائع السابقة، والحيل الشرعية، والاجتهاد والرأي، وما بين هذه العناوين عناوين كثيرة، لا يسع المقام لذكرها كاملة. على أن المؤلف سيبحث في الأجزاء اللاحقة الفقه الاستدلالي المستخرج من قول وفعل وتقرير الإمام الحسين عليه السلام بحسب الأبواب الفقهية المعروفة، وهي الطهارة... الصلاة... الصوم... الخ. وفي النهاية خصص المؤلف فصلاً لأصول الفقه المستفادة من قول، فعل، وتقرير، الإمام الحسين عليه السلام.
