لقد غدت مقولة "مجتمع بلا شيكات وبلا نقود" جزءاً لا يتجزأ من ثقافة الاقتصاد، فظهرت بطاقة الدفع الإلكتروني في وقت لم تكن فيه البيئة التجارية بحاجة إلى وسيلة إضافية للوفاء، بقدر حاجتها إلى وسيلة مضمونة، وقد قامت بطاقة الدفع الإلكتروني بتقديم هذا الضمان الذي يميزها عن وسائل الوفاء التقليدية من خلال تنظيمها للعلاقات القانونية بين أطرافها.
وفي الأردن أصبح التعامل ببطاقة الدفع الإلكتروني يلعب دوراً مهماً، حيث إن عدد البطاقات الصادرة وصل (1.2) مليون بطاقة، أما التجار القابلون لها فقد وصل عددهم إلى (30) ألف تاجراً، وانتشر استخدام التقنيات في الأردن ـ التي تستخدم بواسطتها بطاقة الدفع الإلكترونيـ بشكل كبير، مثل أجهزة الصّراف الآلي (ATM)، وأجهزة البيع الإلكتروني (P.O.S)، والبنوك الإلكترونية (Electronic Banking)، وبنوك الإنترنت(Internet Banking). وقد قوبلت البطاقة - شأنها في ذلك شأن أي تطور جديد - بعدد من التصرفات غير المشروعة سواءً من حاملها أم من مصدرها، أم من القابل لها، أم من الغير، وهذه التصرفات غير المشروعة وإن كانت على مستوى قليل في الأردن نظراً لحداثة اعتماد المواطنين عليها في التعاملات المالية، إلا أنها على مستوى عالٍ في الدول التي عرفت استخدامها منذ عقود، ولا أدل على ذلك من أن خسائر البنوك الأمريكية في عام 2002 بلغت (48) مليار دولار، بينما دلت آخر الإحصائيات التي أجريت في الأردن عن الأعوام (2001، 2002، 2003) أن هناك (28) حالة استخدام غير مشروع لبطاقة دفع إلكتروني لكل مائة ألف حالة.
ولعدم وجود تشريع في المملكة الأردنية الهاشمية يحكم كيفية التعامل ببطاقة الدفع الإلكتروني ـ أسوة بالدول الأخرى ـ تظهر أهمية هذا البحثّ، وضرورته، وفائدته، وانعكاساته على العمل المصرفي، فنظراً لحداثة اعتماد استخدام البطاقات في الوفاء، فقد ظهرت بعض الاستخدامات غير المشروعة المواكبة لاستخدامها، وبالتالي يأتي هذا البحثّ ليبين ماهية الاستخدامات غير المشروعة، وأساليبها، وطرق الحد منها، ومسئولية كل طرف من أطراف العلاقة، حتى نتفاداها في المستقبل، ونمنع من انتشارها، حفاظا على الثقة التجارية في استخدام هذه البطاقات.
