Book Description
يُعدّ هذا الكتاب من الكتب المختصرة والمعتمدة في الفقه الحنبلي، وهو من تأليف الشيخ محمد بن أحمد الفتوحي، والمعروف بابن النجار (972ﻫ)، جمع فيه بين كتابي ((المُقنِع)) لابن قدامة (620ﻫ)، و((التنقيح المُشبِع)) للمَرداوي (885ﻫ)، مع ضم بعض الفوائد والزيادات، مبيِّناً القولَ الصحيح والراجح والمعمول به في المذهب.
وقد تضافرت في هذا الكتاب جهود الأئمة ابن قدامة والمَرداوي وابن النجار، في تحرير المذهب، وتنقيح الأقوال فيه، وبيان القول الراجح الصحيح عند الحنابلة، فجاء الكتاب في قمة كتب الحنابلة المعتمدة في القضاء والفتوى والدراسة والتدريس، ولقي القَبولَ عند العلماء، وانتشر بينهم.
قال المؤلف في خطبة كتابه: ((فالتنقيح المشبع في تحرير أحكام المقنع... قد كان المذهب محتاجاً إلى مثله، إلا أنه غير مستغن عن أصله، فاستخرت الله تعالى أن أجمع مسائلهما في واحد، مع ضم ما تيسر عقله من الفوائد الشوارد، ولا أحذف منهما إلا المستغنى عنه والمرجوح وما بني عليه، ولا أذكر قولاً غير ما قدم أو صحح في التنقيح إلا إذا كان عليه العمل أو أشهر أو قوي الخلاف، فربما أشير إليه. اﻫ)). وقد اعتمده المتأخرون من عصر مؤلفه، حتى كان والد المؤلف يُقْرِؤُه للطلبة، ويثني عليه، وكاد الكتاب لشهرته يُنسِي ما قبله من متون المذهب المُطوّلة، فعكف الناس عليه شرحاً وتحشيةً واختصاراً وجمعاً له مع غيره، وهو ككتاب ((الإقناع))، عليه مدار الفُتيا ومرجع القضاء.
والمؤلف هو: تقي الدين محمد بن أحمد بن عبد العزيز تقي الدين أبو البقاء الفُتُوحِيِّ المِصريِّ، الشهير بابن النجار (898-972ﻫ)، فقيه حنبلي من القضاة، نسبته إلى باب الفتوح بالقاهرة.
