إن من أهم ما اصطَلح عليه البشرُ في نظام حضارتهم الماليةِ إختراعَ النقودِ، وقد أعان ذلك الفقهاءَ كثيراً على تمييز البائع من المشتري في العقود، فباذلُ النقد مشترٍ وباذلُ العرْضِ بائعٌ، لأن النقدينِ يُطلبان ولا يُعرَضان، بخلاف بقية الأشياء، فإنها يَلحُقها العرْضُ والطلبُ.
وقد جاء الإسلامُ فوَجد النقودَ من الذهبِ والفضةِ، فأَقَر التعاملَ بهما ووضَع القواعدَ والضوابطَ لإقامةِ العدْل فيهما، مِن ذلك أن أهلَ المدينةِ كانوا يتعاملون بهما عدداً لا وزناً، لقول عائشة - رضي الله عنها - في الصحيحين في قصةِ شرائِها بَريرةَ: "إنْ شاء أهلُكِ أنْ أَعُدَّها لهم عَدّةً واحدةً فعَلتُ"، أي: أَعُدَّ الدراهمَ نقداً.
وقد عُنِيَ الفقهاءَ بشأن النقود وبيانِ أحكامها، فأَوجبُوا على السلطان إقامةَ العدل في ضرْبها، وحرَّموا عليه الإتجارَ لنفسه بها، كما بيَّنوا حُكمَ إتخاذ النقود من غير النقدَين، وأَسَّسُوا القواعدَ الشرعيةَ الضابطةَ للتعامل بها.
هذا الكتاب تضمن كل فتاوى التي تحرّم الإقدامَ على كسْرِها أو قَرْضِها أو غشْها، وشدَّدوا في إنزال العقوبة على غاشِّها ومُزَوِّرِها بالحَبْس المؤبَّدِ أحياناً، وبالقطع أحياناً، وبين حكمَ المعاملةِ بالمغشوش وضوابطَه، وكيفيةَ قضاءِ الديون المترتبة من بيعِ أو قرضٍ، إذا زالَ التعاملُ بالمغشوشِ، وغيرَ ذلك من الأحكام.
