تبحث هذه الدراسة في سبل الترجيح بين طرق الإثبات المتعارضة في الشريعة والقانون، فقد تتعارض طريقان من طرق الإثبات كالشهادة مع الكتابة، أو مع علم القاضي، أو مع شهادة أخرى، أو نحو ذلك فعندها نحتاج إلى الخروج من هذا التعارض بترجيح بعضها، أو بالجمع بينها أو نحو ذلك، سعياً وراء حكم عادل بعيدٍ عن أي شائبة تشوبه، فكانت هذه الرسالة محطة مهمة في توضيح سبل الخروج من هذا التعارض، تعين القاضي في دفعه، والخروج منه فيما يأتي حكمه في أنصع صورة وأبهاها.
فقد جاءت هذه الدراسة في أربعة فصول وتمهيد: تحدث التمهيد عن طرق الإثبات: تعريفاً، وإطلاقاً وتقييداً، وأهميةً، وتحدث الفصل الأول عن التعارض والترجيح بصفة عامة، وبين طرق الإثبات بصفة خاصة، وكذلك عن سبل الترجيح المعتمدة فقهاً وقانوناً حال وقوع التعارض، أما الفصل الثاني فكان في الجمع والتوفيق بين طرق الإثبات المتعارضة سبيلاً من سبل الترجيح، وشمل ذلك: إعمال البينتين من كل وجه، وإعمالهما من بعض الوجوه دون بعض.
أما الفصل الثالث فتحدث عن الترجيح بين طرق الإثبات المتعارضة، وقد فصل الحديث في القوة الإثباتية لكل طريق من طرق الإثبات، مبيناً جوانب الضعف والقوة فيها، كما تحدث عما يصاحب البينات من قرائن وظروف تكون مرجحة وداعمة لها، ومدى قوة تلك القرينة وأثرها في الترجيح.
أما الفصل الرابع فقد تحدث عن تساقط طرق الإثبات المتعارضة، وهي الحالة التي يلجأ إليها القاضي عند تعذر الترجيح بوجه من الوجه بسبب التعارض المطبق.
تلا ذلك خاتمة أبرزت أهم النتائج والتوصيات التي توصل إليها الباحث.
