إن الرغبة في التملك ومن ورائها غريزة حب البقاء هي الحركة الدائبة في الحياة، وهي الغذاء القوي الفعال لبعث النشاط في الأحياء، وهي الموجة لهذا النشاط في كل ميدان من ميادين العمل. فمن أجل المال يتصارع الناس، وفي سبيله يختصمون وعلى مورده يتزاحمون، ولهذا كان هذا الصراع الطويل بين الأفراد والجماعات والأمم منذ وجدت الحياة على هذه اليوم إلى ما بعد اليوم ولهذا كان لا بد من تنظيم العلاقة المالية بين الناس حتى يعرف الإنسان ما له وما عليه، حتى يكون المال له، فله عندئذ أخذه واسترداده واسترجاعه من غيره، ولو كان قد استهلكه وذلك بتضمينه إياه، وحتى يكون ما في يده حقاً لغيره عليه أن يعيده له، وقد جاءت الشريعة الإسلامية بالبيان الواضع لهذا، حتى لا تصغى جهة على أخرى، ولأهمية هذا الموضوع اعتنى فقهاءنا بمعالجته في أبواب الفقه المختلفة: من بيع وإجارة وهبة وقرض ووديعة وعارية وجنايات وزكاة، وما إلى ذلك مستنيرين بكتاب الله وسنة نبيه محمد (صلى الله عليه وسلم)، وأمام هذا كان لا بد أن تقوم دراسة عميقة مستفيضة لموضوع استرداد المال، تستجمع بين ثناياها هذا المبحث في كتاب واحد ليسهل الرجوع إليه والاستفادة منه، وشعوراً من المؤلف "سعدي حسين علي جبر" بهذه الحال رأى أن يكون موضوع رسالته للحصول على درجة الدكتوراه من كلية الشريعة بجامعة الإمام محمد بن سعود الإسلامية في هذا المجال. وقد فرضت عليه طبيعة البحث أن يقسمه إلى ثمانية أبواب، يسبقها باب تمهيدي. ثم اختتم الرسالة بتقعيد قواعد لحالات الاسترداد في هذه الرسالة وبيان ما توصلت إليه من نتائج.
