يتناول هذا الكتاب في الباب الأول القانون، وهو مجموعة من القواعد القانونية التي تضعها السلطة المختصة لتنظيم الروابط الاجتماعية بين الأفراد داخل المجتمع، وإلزام الأفراد باحترامها وإلا تعرضوا للجزاء، ويتعلم عن تطور القانون حيث كان يعتبر في الحضارات القديمة شيئا ثابتا لا يقبل التبديل، أو تفكير كقوانين ببابل والمصريين. والسبب في ذلك هو العامل الديني لأن الإله هو المشرع والحارس.
إلا أن التقدم الحضاري الذي واكب الشعوب وأدى إلى ثورة فكرية غير المفاهيم والمعتقدات القديمة. وأسباب ذلك تعود الى عوامل كالغزو والتفسير والتقنين والسلطة التشريعية.
ثم يشير إلى أهداف القانون وهو دعم السلام والتوفيق بين المصالح المتعارضة وحفظ النظام، ويتطرق إلى قواعد الدين، حيث تنظمها الرابطة التي تقوم بين الفرد وخلقه، والرابطة التي تقوم بين الفرد ونفسه، والرابطة التي تقوم به الفرد وغيره من الأفراد في المجتمع، والدين هو الذي ينظم هذه الرابطة بين الناس.
ويفرد في الباب الثاني مساحة واسعة للحديث عن القوانين العامة التي تنظم علاقة الدولة مع الأفراد والقوانين الخاصة فهي التي تنظم العلاقة بين الأفراد أنفسهم بمفرد عن الدولة وعناصر التمييز بين هذين القانونين، فالعنصر المادي يقوم التمييز على فكرة بسيطة أساسها القانون العام هو ذلك القانون المطبق على الدولة والشخصيات العامة وأما العنصر الشكلي يمكن التعريف بين القانون العام والخاص على أساس وجهة نظر شكلية من ناحية الأمور الفنية.
على هذا الأساس يبرز معنى القانون العام في اللحظة التي ينشأ فيها مفهوم تقاعدي وأسلوب قضائي مختلف عما هو مطبق بمادة في التنظيم علاقات الأفراد أما العنصر الوظيفي يساعد على التميز بين القانون العام والقانون الخاص.
