في خيانة للتنظيم السيء والعمل السيء للمرافق، نشأ الخطأ بشكل سابق للمسؤولية وقد تمت معاقبته لمدة طويلة من قبل القانون التنظيمي والمسلكي؛ وحالياً، لا زال يؤدي وظائف متميزة عن المسؤولية ونزاعها، مرتبطاً بنظام الحياة الإدارية وبمعاقبة تصرفات سوء الإدارة.
يسمح الخطأ من وجهة نظر الحياة الداخلية للإدارة، عبر رقابة خط السلوك، أن ينظم المؤسسة الإدارية في تنظيمها وعلاقاتها الداخلية، وهو لا يقيّم فقط بالنسبة للقواعد الخارجية للشرعية، ولكن حسب القوانين الخاصة بالحياة الإدارية كذلك؛ قوانين السلوك الجيد، ومجموعات السلوك الحسن والأخلاقيات الإدارية، وهكذا لا يملك القاضي أي إحتكار في تحديد وقمع خطأ الإدارة، ويقوم كذلك بتعيين الحدود التي يمكن أن تتحرك فيها الإدارة، مظهرة الروابط الوثيقة مع الإدارة السيئة ومخالفة القوانين ومخالفة الموجب واللوم المعنوي.
ويؤدي الخطأ في وجهة النظر الخارجية للإدارة أمرين تكميليين، متتابعين تاريخياً، في إصلاح الضرر الذي تسببه الإدارة، وبإعتباره شرطاً للتعويض، فإنه يسمح من ناحية أولى، بإطلاق هذا الأخير، إلا أنه يجد نفسه محدوداً بفرضيات المسؤولية دون خطأ وبالمكان الممنوح للضرر ولصلة السببية، وهو يتدخل من ناحية ثانية، في التنظيم الفعلي للتعويض، وبالتحديد في تبعة عبء التعويض عبر تعيين فاعلي الموجب والمساهمة في الدين، في المقابل، لا يمكن أن يكون دوره، تطبيقاً لمبدأ التعويض الكامل، إلا عرضياً في قياس التعويض.
