يهدف هذا الكتاب تحديداً إلى بحث موضوع في غاية الأهمية، ألا وهو موضوع العقود الإلكترونية الحديثة التي تتم عن بعد، وعلى الشبكة، في إطار التجارة الإلكترونية الدولية وتبدو أهمية الموضوع في عصر تسنت فيه وسائل الإتصالات الحديثة التي تمتلك فعالية كبيرة قادرة على ربط الإنسان مع العالم من خلال جهاز "الحاسوب" إلى درجة يمكن فيها تسمية هذا العصر من خلال جهاز الحاسوب إلى درجة يمكن فيها تسمية هذا العصر "بعصر الإنترنت" المنفتح من خلال شبكة سهلة الإستعمال، وفي متناول الكافة، انتشرت عبر العالم وقدر لها قسطاً كبيراً من النجاح.
وفي مقابل هذا النجاح ظهر الكثير من المشاكل والتعقيدات القانونية، والتي رافقت تلك التكنولوجيا المتطورة، فإذا كانت دوائر الشبكات المغلقة توجب وجود مالك واحد، يُحدد من هم ذوو الحق في إستخدامها وقواعد إستخدام الشبكة، وشروطها، كطرق الإثبات وطرق دفع الثمن وطرق القبول وتكوين العقد وسواها من القواعد والشروط وبعكس ذلك فإن الشبكات المفتوحة فيها ينقصها وضع نظام مماثل للشبكات المغلقة، يحدد حقوق وموجبات مستخدمي شبكة الإنترنت، لأن ذلك يتطلب قدرة عالية من التنظيم، ويتطلب أيضاً تدخل المشرع على المستويين المحلي والعالمي.
من هنا تأتي هذه الدراسة كمحاولة جادة للإحاطة بموضوع يحمل في طياته تحدياً بين التقليد والحداثة، بين العام والخاص وبين القوانين الوضعية، والقوانين الدولية، بين القواعد المادية، والقواعد الإتفاقية؛ لذلك تعرض المؤلف للمفهوم المعاصر للتجارة الإلكترونية الدولية، ودور المنظمات الدولية، والدور الإتفاقي في التجارة الدولية.
