إن الاختلاف لا يقتصر على المذاهب المشهورة، بل وجد ضمن المذهب الواحد، فأتباع أبي حنيفة يختلفون، وكذلك أتباع مالك وأتباع الشافعي ونحو ذلك، وهذا الاختلاف، اجتهاد، وفي اختلاف الاجتهادات يسر في الدين.
ومن الكتب التي اشتملت على اختلاف بين أتباع المذهب الشافعي الرسالة المسماة بـ(إثمتد العينين في اختلاف الشيخين) للشيخ علي بن أحمد بن سعيد أبو حبرين، وهي رسالة عظيمة الفائدة، لأنها تعطي الفقيه الشافعي صورة الاختلاف بين أهل الفتوى من هذا المذهب، ولا تقتصر على ذكر الخلاف بين الشيخين الإمامين العلمين الشهيرين: أحمد بن محمد بن حجر الهيثمي، وشمس الدين محمد بن أحمد الرملي، بل تستوعب ذكر آراء الشارحين والمُحَشِّين من أئمة المذهب، الذين انتهت إليهم مدار الفتوى، فم على المفتي إلا أن يختار الرأي الذي يشاء.
