لا شكَّ أَنَّ لكل فلسفة رهاناتُها التي تبيِّن أهمية المشكِل الذي تعمل على طرحه للبحث، وتجعله هدفها من البحث، ومن هنا يمكن تلمس راهنية هذه الفلسفة التي تكشف عن واقعنا الراهن الذي يشكِّلُ ضاغطاً على الفلسفة ويدفعها إلى التصدي له، ولا شكَّ فإنّ فلسفة القانون تبقى متمثلةً إلى حد كبير في كونها تعمل على "تحديد وحماية المصالح العامة والخاصة للمجتمع الخاضع لها حيث إن القانون يشرع ويعدل ويلغي ويطبق وينفذ على أساس تلك المصالح التي هي غاياته "وإذا كان مجال إهتمامها يتعلق بالمجتمع فمن المؤكَّد أنَّ هذا يجعلها تواجه إشكالياتٍ متنوعة بتنوع الواقع الإجتماعيّ الذي تتصدى إلى معالجة مشاكله، وهذا التنوع على صعيد الزمان وعلى صعيد المكان إذ لكل مجتمع رهاناته وتحدياته وهي تتنوع لكنها تبقى تدخل ضمن نطاق الإشكالية التي تكشف عن المتداخل والمترابط في إشكالية واحدة تعمل على تحليلها ونقدها بشكل مترابط متدرج من جزء إلى آخر بحسب الأهمية والأثر.
لذلك، تتنوع الأطاريح بتنوع تلك الإشكاليات، فالأطروحة مطابقة إلى طبيعة المجتمع أو الباحث الذي يبحث في تلك الإشكالية؛ فيحاول صياغة معالجة لها، وهناك تنوع في الأطاريح فمنها ما هو غائبٍ أو مناقض أو جزئي في معالجة الإشكاليَّة.
إن هذا الكتاب أريد له أن يقدِّمَ معالجات متنوعة، وعلى الرغم من تنوعها إلاَّ أنَّها تنتمي إلى فلسفة القانون، وتحاول أن تعالج مفهوم العدالة وما يقدمه من رهانات عبر تاريخيَّة هذه الفلسفة ونماذجها المتنوعة على صعيد الزمان والمكان.
