مما جاء به الدين الحنيف نظام الوقف، شُرع بالسنة المطهرة، وتكاد الأمة أن تكون مجمعة على مشروعيته من حيث الجملة. وكان النبي صلى الله عليه وسلم يحثّ عليه بأقواله، ويرشد إليه بأفعاله. ويسمي الوقف حبساً، وصدقة. وهو نوع من أنواع الصدقة، إلا أن أصلها لا يباع، بل ينتفع بها مباشرة، أو تصرف غلتها إلى الموقوف عليهم. وقد قامت غلاّت الأوقاف في الحياة الإسلامية، ولا تزال تقوم، بدور كبير في التمكين للإسلام، وتعليمه ونشره، وفي إمداد نواحي الخير، ومشاريع المعروف والبرّ، بالإمكانيات المادية التي تيسِّر إنشاءها واستمرارها، في كفاية أهل الحاجة والعسر، وانتشال كثير منهم من وهدة الفقر، وصيانة وجوههم عن الحاجة إلى الناس.
من هنا تأتي أهمية هذا الكتاب الذي أخذ عنوانه مما أورده المؤلف في المقدمة. ويذكر المؤلف بأنه "اقتضبه من مؤلفه الكبير" ولعله يفي كتابه "الفائق في الفقه". ويعتبر كتاب "مجموع في المناقلة والاستبدال بالأوقاف" حجة في هذه المسألة "الأوقاف"، ونموذجاً للبحث العلمي الدقيق الموصل إلى نتائج جلية محددة، توافق السنة وتحقق المصالح.
وقد قسّم المؤلف كتابه هذا إلى خمسة مناهج: الأول في ذكر من قال بالمناقلة للمصلحة من علماء الأمة. الثاني في إثبات أن من مذهب الإمام أحمد إجازة المناقلة في الوقف وتبديله وتغييره وتحويله وإزالته عن هيئته. وأن وضعه منوط بالمصلحة الراجحة للوقف وأهله. الثالث في ذكر الأدلة الشرعية على جواز المناقلة والاستبدال، الرابع في ذكر أدلة المخالفين في المسألة والمنهج الخامس: في فوائد تتعلق بهذه المسألة. والكتاب نافع في هذا الموضوع وفيه نقول كثيرة عن الإمام أحمد.
