إن بحر الشريعة عظيم متلاحم الأمواج، والخوض فيه على جانب من الخطورة عظيم، ويحتاج من يخوض غماره أن تكون عنده أساسيات، وأن تكون أمامه منارات، لئلا يتيه. ومن المنارات معرفة الأصول الفقهية والقواعد الكلية، وعموميات الشريعة، فضبط الفقه بقواعده يغني عن حفظ كثير من الجزئيات التي قد ينفق فيها الباحث عمره، ولا يطلع عليها جميعها، كما أنه يحول دون اضطراب المسائل كما يذكر الشاطبي. ومن الأساسيات أن يلم الباحث بالخلافيات، ويعرف مفارق الطرق ودواعي المآخذ المختلفة، وأسباب تعدد الآراء. فمعرفة الخلاف وأسبابه أمر ضروري لمن يشتغل بالفقه، حتى يدرك مآخذ الفقهاء ومنازع أهل العلم، فلا يقع في عرض أحد منهم، ولا يتعصب لرأي بدا ضعف مستنده. ولذلك اهتم الفقهاء قديماً وحديثاً، ببيان الخلاف، وكتبوا في مسائله.
في هذا الإطار يأتي هذا الكتاب وهو الذي على قدر كبير من الأهمية في موضوعه، إذ أنه يبحث في الخلاف بين أبي حنيفة وأصحابه، مع بيان مواقف الأئمة الآخرين من هذا الخلاف. وقد استوجب ذلك من الباحث كتابة مقدمة موجزة في أسباب الخلاف منذ عصر الصحابة رضي الله عنهم، حتى عصر الفقهاء الأربعة، كما استوجب الأمر الكتابة في الحياة العلمية لأئمة الفقه الحنفي، وأخيراً كان لا بد للباحث من حصر المسائل الفقهية بصورة أو بأخرى، لذا عمد، ولهذا الغرض، إلى كتاب "تأسيس النظر" للدبوسي الحنفي، متناولاً على ضوئه الأصول الفرعية ببعض الشرح والبيان، ليتناول من ثم مسألة أو أكثر على كل أصل بالشرح والمناقشة، مكتفياً بذلك عن شرح بقية المسائل.
وعلى هذا فإن البحث احتوى على مقدمة وثلاثة أبواب: المقدمة في أسباب الاختلاف بوجه عام. الباب الأول: النشأة العلمية لأئمة المذهب الحنفي. الباب الثاني: الخلاف بين أبي حنيفة وأصحابه. الباب الثالث: الخلاف بين أبي حنيفة والأئمة الآخرين. وتجدر الإشارة إلى أن هذا البحث كان بمثابة رسالة قدمها الباحث لنيل درجة العالمية (الدكتوراه) في الفقه المقارن، وذلك من جامعة الأزهر العريقة.
