القانون هو وليد البيئة يأخذ منها ويعطيها، يعكس أحوالها وأوضاعها ويعالج مشاكلها الاجتماعية والاقتصادية والسياسية وغيرها. من هنا كانت الأهمية الخاصة التي تحيط في هذه المرحلة بالذات بقانون الإيجار الجديد، إذ على المشترع أن يراعي جانب المستأجر دون أن تغيب عنه مصلحة المالك كما كان عليه أن يعمل على احترام الحرية الفردية وصيانة الملكية الخاصة.
وبنتيجة التطور الكبير والنمو السريع في حركة البناء والعمران وما رافق ذلك من تقدم مماثل في الصناعة والتجارة تحتم على المشترع عند وضع قانون الإيجار الجديد أن يأخذ بكل هذه الاعتبارات ويفرق بين الأبنية المعدة للسكن وبين الأبنية المعدة للصناعة أو التجارة أو المهن الحرة. ويميز بين الإيجارات القديمة والحديثة ويضع حداً لتمادي المالك أو المستأجر ويعيد النظر في قيم التعويض انسجاماً مع ارتفاع مستوى المعيشة وغلائها.
أما وقد صدر القانون الجديد للإيجارات وطرحت فيه مسائل جديدة عديدة، وبالنظر لحاجة القارئ لمعرفة وثائق هذا الموضوع فقد اعتنى الدكتور عفيف شمس الدين" بتناول هذا القانون بالشرح والتحليل من أجل تبسيطه ووضع في متناول الجميع، محتفظاً بما يدخل في صلب مهمة القاضي من تفسير لنية المشترع وبيان لمقاصده دون التعرض لما يدخل في اختصاص المشترع من وضع النصوص التشريعية وإيجاد الحلول للمسائل التي تعترض مسيرة المجتمع وملاءمتها أو عدم ملاءمتها للأوضاع الطارئة. على أن هذا الأمر لا يمنع من معالجة بعض المشاكل عند عدم النص أو إبهامه تمشياً مع اجتهاد القاضي في مثل هذا المجال.
