Book Description
الشكل كما عرفه بعض الفقهاء بأنه المظهر الخارجي للعمل القانوني، فهو التعبير المادي عن إرادة من يشارك في تحضير العمل القانوني وإبرامه.
فالإرادة هي جوهر التصرف، والشكل هو إخراج هذه الإرادة إلى الخارج، وهو كناية عن القالب الذي يوضع في العمل القانوني لكي ينتج آثاره، وهو وسيلة التعبير عن العمل القانوني، وبالتالي لا يوجد أي عمل قانوني يترتب عليه مفاعيل دون أن يظهر بشكل معين.
وللشكل حسناته وسيئاته تجاه فرقاء العقد، وتجاه الغير، فمن أبرز محاسن الشكل، والدور الحديث الذي يتجلى بالصيغة الحمائية، ويعتبر أداةً سهلةً للإثبات، كما يعتبر في بعض الأحيان، تعزيزاً للرضائية ولإرادة المتعاقدين.
أما مساوئ الشكل، فتتجلى بأنه يعتبر إستثناءً على مبدأ الرضائية في معظم الأحيان وقيداً على إنتاج العقد لمفاعيله في أحوالٍ أخرى، كما أنه يحول دون سرعة وتسهيل المعاملات.
ولكن تعدد الصيغ الشكلية، يحتّم رسم حدود لهذه الصيغ، ولا يتم ذلك إلا عبر معيار الجزاء المعتمد على عدم إستيفاء العقود للشكليات المتطلبة قانوناً، وهذا عمد المؤلف لدراسته في القسم الثاني من هذا الكتاب، تاركاً القسم الأول لدراسة تحليلية لمبدأ سلطان الإرادة في مرحلة إنشاء العقد، وفي مرحلة إحداثه لمفاعيله، وللعلاقة القائمة بين الشكل والرضى.
لذلك تم هذا الكتاب إلى قسمين إثنين: القسم الأول: مبدأ سلطان الإرادة وعلاقة الشكل بالرضى، القسم الثاني: الجزاء على عدم مراعاة الشكل في العقود.
