إن هذه الدراسة التي بين أيدكم هي-بالأساس-محاضرات ألقيت على طلاب السنة الثالثة والرابعة في مرحلة الإجازة-الليسانس-لكل من معهد الرسول الأكرم العالي للدراسات الإسلامية-بيروت. ومعهد السيدة الزهراء العالي للدراسات الإسلامية-بيروت-للعام الدراسي-1421-1422هـ و1422-1423هـ. وبالرجوع لفصول وأبحاث الكتاب نجد أنها قد جاءت مرتبة في مقدمة، وتمهيد، وفصول ثلاثة وخاتمة. تطرق المؤلف في التمهيد إلى مقدمات ضرورية للبحث، وهي عبارة عن المنهج الذي اعتمده في دراسته، التعريف بفقه الدولة، بيان أهمية الموضوع والحاجة إليه، وتوضيح مفاهيمه حول جملة من المصطلحات المتعلقة بنظريات الحكم والدولة. وأشار في الفصل الأول إلى النظريات المفسرة لأصل نشأة الدولة في الفكر السياسي، من خلال مبحثين مستقلين، تعرض في الأول إلى النظريات العقدية وفي الثاني إلى النظريات غير العقدية. وتناول في الفصل الثاني، أركان الدولة، أشكالها، ومهماتها من منظور إسلامي من خلال عقد مباحث ثلاثة، ففي البحث الأول، أشار إلى الأركان الأربعة للدولة في القانون الدستوري (الشعب، الأرض، السلطة، السيادة)، مؤكداً على المفهوم الإسلامي لهذه الأركان، وأضاف ركناً خامساً هو الركن المعنوي لتصبح الأركان الخمسة من نظور إسلامي. وفي المبحث الثاني، أشار إلى أشكال الدولة في الفكر الفلسفي وفي القانون الدستوري والإداري مذيّلاً المطالب بالتوجه الإسلامي، وفي المبحث الثالث والأخير من الفصل الثاني شرح وظائف الدولة القانونية والدينية.
كما تناول في الفصل الثالث نظريات الحكم من منظور إسلامي، حاصراً النظريات الإسلامية الكبرى بنظريات ثلاث: نظرية ولاية أهل الحل والعقد. ونظرية ولاية الأمة، ونظرية ولاية الفقيه، وختم الدراسة بخاتمة تضمنت التأكيد على أهمية مواصلة الدراسة من قبل الباحثين والمختصين في هذا المجال.
