تكمن أهمية موضوع أحكام المسنين في الحياة المعاصرة، في أن هذه الفئة من المجتمع محل رعاية وإهتمام من علماء الفقه الإسلامي سواء ذّكر المسنون بالنص أم بالوصف، وفي زماننا هذا توالت الكتابات وانعقدت المؤتمرات وأنشئت المراكز والمؤسسات العربية والعالمية مظهرة الإهتمام بالسنين ودراسة أحوالهم، ولكن كان ذلك من الجوانب الإجتماعية والنفسية والطبية والإقتصادية.
وبما أن البضاعة العلمية للغرب لا تولي إهتماماً بالجانب التعبدي، ففاقد الشيء لا يعطيه فإنه من المؤسف أن بعض المسلمين المهتمين بدراسة أحوال السنين ساروا وفق ذلك المنهج فأعدت الرسائل والبحوث والدراسات بشأن المسنين من غير إشارة إلى إهتمام التشريع الإسلامي بهم، مع أن منهم من استند إلى بعض النصوص الشرعية، المتعلقة بالجوانب الإجتماعية أو النفسية أو الطبية أو الإقتصادية مع إغفال الجانب الفقهي التفصيلي المبني على الأدلة الشرعية من الكتاب والسنّة والإجتماع والمعقول المعتبر؛ مما يمكن أن يكون تأصيلاً شرعياً لتلك الجوانب.
لذا، كان من الملازم أن تهتم المؤسسات العلمية المتخصصة ببحث أحكام المسنين إهتماماً بهذه الفئة في المجتمع الإسلامي وإبرازاً للفقه الإسلامي وشموله لعموم طبقات المجتمع وإظهاراً لمحاسن دين الإسلام وصلاحيته لكل زمان ومكان.
من هذا المنطلق، جمع الأستاذ سعد الحقباني في هذا الكتاب المسائل المتعلقة بالمسنين في أبواب الفقه المتنوعة ورتّبها ليسهل الإطلاع عليها وخاصة من الفئة المعينة بالبحث؛ ولإثراء المكتبة الإسلامية وإضافة بحث جديد متخصص.
وللإحاطة بالموضوع، يتألف البحث من تمهيد، وبابين، وخاتمة، وفهارس على النحو التالي: التمهيد: المراد بالمسن ورعايته في الشريعة، الباب الأول: "أحكام المسن في العبادات"، الباب الثاني: "أحكام المسن في فقه الأسرة والمعاملات والجنايات والحدود"، أما الخاتمة: وقد تضمنت طرفاً من أبرز النتائج التي توصل إليها هذا البحث.
